Is it really an iPad 4G if it can't connect to a 4G network?

In Australia, Apple is defending the 4G designation on its new iPad, despite complaints from the?Australian Competition and Consumer Commission.

In Australia, Apple brands its top-selling tablet the "iPad Wifi + 4G," a designation that seems to imply that the device will connect to a 4G signal. But as the Australian Competition and Consumer Commission recently pointed out, the iPad is not actually compatible with any of the 4G networks down under. This week, the issue made its way to an Australian federal court, which will decide whether or not Apple misled consumers.?

According to the Australian newspaper, Apple has already agreed to issue refunds to shoppers who expected the new iPad to connect to the 4G network provided by local provider Telstra. But the company promised to fight the allegations from the Australian Competition and Consumer Commission, and refused to remove the 4G moniker from the device.?

The phrase 4G, Apple said in a statement, "conveys to consumers in Australia that the iPad with WiFi + 4G will deliver a superior level of service in terms of data transfer speed (consistent with accepted industry and regulatory use of that term), and not that the iPad with WiFi + 4G is compatible with any particular network technology promoted by a particular mobile service provider in Australia."

In other words, 4G is not a matter of any specific network, but a matter of speed.?

In a smart post over at ZD Net, Zack Whittaker breaks down the reason the iPad won't work on 4G networks outside the US and Canada.?

The new iPad, he writes, only works "on the 700Mhz and the 2100Mhz bands of the mobile spectrum. Other countries have already allocated their wireless spectrum to other things ? like in the UK, the 700Mhz band is reserved for free-to-air digital Freeview television, and similarly in Australia, the band is used for analogue television.?UK customers are doubly out of luck, because the wireless spectrum designated for?4G LTE services hasn?t been divided up yet."?

So that being said, do you believe Apple has a duty to rebrand the iPad in the Australian and European markets? Drop us a line in the comments section.?

Diablo 3 beta throws open doors, this weekend only

Diablo 3, the much-anticipated fantasy game, is scheduled for launch in North America on May 15. In the meantime, you can get your hands on the?Diablo 3?beta version.

Diablo 3: One of the most eagerly-anticipated games in recent memory, and also one of the most frequently delayed. Horizons readers will remember that back in September of last year,?Blizzard announced that Diablo 3, originally slated to arrive in 2011, would be held until early 2012 ? enough time for the developer to polish up the gameplay.?

"[T]his week we pulled together people from all of the teams involved with the game to decide whether we felt it would be ready before the end of December, and we grudgingly came to the conclusion that it would not," a Blizzard exec wrote at the time. "Ultimately, we feel that to deliver an awesome Diablo sequel that lives up to our expectations and yours as well, we should take a little more time and add further polish to a few different elements of the game."

Since then, Blizzard has finalized a May 15 North America launch date for Diablo 3.?

This week comes news that Blizzard will stage an open beta event for Diablo 3, a kind of "stress test" for the forthcoming fantasy title. VentureBeat?reports?that the beta test will extend from Friday afternoon to 1 p.m. EST on Monday. Anyone with a valid?Battle.net account is invited to play (excepting folks in the?Korea, Taiwan, Hong Kong, and Macau markets, who are getting a separate beta event, on April 23).

You can get started here.?

Diablo 3, like Diablo 2 and the original Diablo, will take place in the the murky, shadowy world of Sanctuary. Among the playable character classes are the newly-introduced "monks" ? "priest-warriors who follow the divine injunctions of their Patriarchs, the rulers of Ivgorod," according to Blizzard. Sounds like some good, geeky fun to us.?

LG's 5-inch Optimus Vu shipping soon in white (in Korea, at least)

white lg optimus vu smartphone

Just under two months after LG's Optimus Vu got priced for the hometown market, in flies news that another hue will soon be on those very same shelves. The 5-inch, 4:3 ratio'd Android smartphone will soon hit South Korea in white, purportedly targeting the "younger" market -- you know, folks who like "cool" things (LG's translated words, not ours). Folks can look for the device -- which should remain unchanged outside of the external color -- to hit SK Telecom as early as next week, but there's no word on when (or if) it'll spread to other markets.

By Us Weekly

The day before Dick Clark died of a massive heart attack, he underwent prostate surgery.

According to the death certificate (obtained by TMZ), the beloved TV and radio host underwent surgery on April 17 on his prostate due to acute urinary retention.

The next morning, Clark died from a heart attack at St. John's Hospital in Santa Monica at the age of 82.

Clark's friend,?Rep. David Dreier (R-Calif.), told Extra, "He had very minor prostate surgery. All of a sudden, he got a feeling in his arm about 9:30 [Wednesday] morning and he was gone by 11:15. It turned out to be a massive heart attack."

The certificate states Clark died from acute myocardial infarction (a heart attack) and that he suffered from coronary artery disease.

His "New Year's Rockin' Eve" cohost Ryan Seacrest paid tribute to his deceased mentor on last Wednesday's episode of "American Idol."

"We can't begin tonight's show without acknowledging the passing of a TV pioneer and my dear friend Dick Clark," Seacrest said of the "American Bandstand" host and mega-successful TV producer. "Without Dick a show like this would not exist. He will be missed greatly. I know he's in a better place, saying, 'Hey, let's get on with the show.'"

He added, "You got it, boss."

Clark is survived by three children and his third wife, Kari Wigton.

Student loans: Is petition to forgive debt completely a good idea?

Students and parents will think so. But blanket amnesty for all student loans could destroy the student-loan system and might not do much to address the underlying problem.?

Large numbers tend to get people?s attention, especially the 13-digit kind. So now with news that student college debt is hitting the $1,000,000,000,000 mark, everyone seems to be talking about it.

President Obama wants to delay the interest-rate hike on government-backed student loans scheduled for this July and will say so in his Saturday radio address ? and then again when he hits college campuses next week to promote the plan. For their part, Department of Education officials stood up for the plan on Friday. And April 25, the Occupy movement is set to occupy colleges to highlight the issue.?

But an online petition that has gathered nearly 700,000 signatures has a better idea ? erase the debt completely, says creator Robert Applebaum.

?Forgiving the student loan debt of all Americans will have an immediate stimulative effect on our economy," he says in the petition. "With the stroke of the president's pen, millions of Americans would suddenly have hundreds, or in some cases, thousands of extra dollars in their pockets each and every month to spend on ailing sectors of the economy."

Forgiving student loan debt, he adds, ?rather than tax cuts for corporations, millionaires, and billionaires, has a much greater chance of helping to raise [the economic] tide in a much shorter time-frame.?

But while the idea has certainly gotten the ear of beleaguered grads ? and their families ? erasing a?trillion dollars of debt by presidential fiat could destroy the future of college loans while doing nothing to address the underlying problem, economists and financial experts say.

Regardless of whether the loan is a government or private loan, forgiveness will mean someone loses. Either the taxpayers in aggregate in the case of federal loans or private lenders on private loans

?Who in their right mind, A) would make loans to students if the loans can be forgiven later on? Or B) invest in an income trust vehicle where the asset of the investment can disappear due to 'forgiveness?' ??says?Kevin Worthley, a?certified financial planner in?Rhode Island and a specialist in college financial strategies,?via e-mail.?

Even if there were lenders willing to risk their money, ?the interest rate they would rightfully require for the risk incurred may likely be far more than future students would be willing to pay and cries of 'usury' to the government could result,? he adds.

Credit is?fundamentally based upon trust, agrees?Mitchell Weiss, adjunct professor at the University of Hartford's?Barney School of Business?in Connecticut.

?If I loan you some money, I trust that you?re going to pay it back to me,? he says. ?Wholesale forgiveness, amnesty ? whatever you want to call it ? will fundamentally undermine a process that is thoroughly integrated within our society.??

Moreover, it doesn't really solve the problem, says Professor Weiss.

?Students need better financial tools," says Weiss, the author of ?Life Happens,? a textbook for student financial planning. "But the laws need to be adjusted as well, Bankruptcy laws need to be amended."

A 2005 change in bankruptcy law means that "education loans are not dischargeable in bankruptcy except in cases of undue hardship.? This, he says, "is really tough to prove.?

Loosening the law would give lenders and ex-students more leeway to find compromises, he says.?

?When a lender knows that the person that?s sitting on the other side of the table has the ability to pull the plug by declaring bankruptcy, and ... that lender doesn?t have collateral to foreclose upon in order to make itself whole, then that lender is pretty motivated to find a compromise solution to avoid the loss that would surely follow,? he says.?

Will the petition make any difference?

Possibly, says Lindsay Hoffman, communication professor at the University of Delaware. Online social media has the ability to reverse the relationship between the government and the governed, she notes.

?Politicians used to set out what they thought was important and voters would respond,? she says, but ?what we are seeing here is a reversal of the agenda-setting process.?

Increasingly powerful social media tools such as this online petition have the power to ?set the agenda and politicians respond to those collective voices being raised.?

"That,? she says, ?is something new.?

Indeed, the political action group Moveon.org has picked up on the momentum behind Mr. Applebaum's original petition to funnel support to a bill now before Congress, the Student Loan Forgiveness Act of 2012, which would help students with loans ? though it is not a complete amnesty.?

Dropbox simplifies sharing with file viewer and folder links

Dropbox is one of those tools that makes our lives a lot easier around the Engadget compound and our various satellite lairs. So, it only makes sense that we'd get a little excited when the company updates and improves the file syncing service. Now, sharing is a bit simpler, with the ability to generate a public link for any file or folder and have it open in a web-based viewer. This can be accomplished both from the website and on the desktop by right clicking and selecting get link. Those using the beta version of the Dropbox desktop client have enjoyed some of these features for sometime, but now the full suite of file viewing and folder sharing options are standard issue for all. Check out the PR after the break.

New iPhone Unlock Should Work With Any Model

77839iPhone unlocks are usually a tetchy experience - you have to have the right firmware on the right model iPhone at the right time. Now, however, thanks to a method that spoofs the activation server, you can unlock almost any iPhone semi-permanently. The system, called Subscriber Artificial Module or SAM, requires a jailbroken iPhone and Cydia. To run it, you de-activate your phone, insert a new SIM, and then activate SAM. SAM spoofs the activation process, convincing the phone that it has been unlocked properly and without issues.
